Anna Chambers was arrested for having drugs and loaded into a van by two NYPD undercover Officers, Eddie Martins and Richard Hall. Chambers says she was then forced to preform sexual acts on Hall and subsequently raped by Martins, all while in handcuffs.
The only defense the Officers had was to claim that it was consensual. The defense lawyers used risqué images taken from Chambers Twitter account to try to establish that a real victim of rape would not be seen in a picture wearing a bikini in an attempt to slut shame Chambers. These officers pleaded guilty to 11 charges also including misconduct and bribery, they were only given 5 years probation and zero prison time. I guess we all need to inform the woman in our lives that if they ever post a sexy picture on twitter it is justification for a police officer to rape them.
Whether you choose to believe the victims story or not, it is clear to any normal human out there that someone in police custody cannot clearly consist to sex in anyway and the professionalism of an Officer should dictate that you not try to bang someone in your custody. Thankfully after this incident the law has been changed, Senate bill S7708 A Person “under arrest, detention or otherwise in actual custody” by a police officer or other law enforcement official, that person is incapable of consenting to a sexual encounter. So in short there’s no uncoerced sex in police custody, there’s only rape.
