PITTSBURGH, PENNSYLVANIA: The Draconian and ridiculous firearm restrictions that the city council voted to pass earlier this year were just invalidated by an Allegheny County Judge on Tuesday.
The Pennsylvania Uniform Firearms Act was brought, then Judge Joseph James acknowledged its relevancy and that it overtakes the city’s authority to pass these types of laws. Gun rights advocates and the attorneys argued that the Act trumps Mayor Peduto’s power to put forth restriction on firearms. The Gun rights activists actually came to us with advice and pointers on how to amass a large group to march on the Mayor’s office. Here’s the story from Back in January.
Judge James sitting comfortably in his black robe said “Stated simply, under the doctrine of field preemption, the UFA preempts any local regulation pertaining to the regulation of firearms,” he continued “The Uniform Firearms Act is a comprehensive statute that evidences an intent by the Legislature to preempt the entire field of firearms and ammunition across the state of Pennsylvania.”
In a knee-jerk reaction to the senseless shooting at a jewish temple
in Pittsburgh, The progressive Mayor wanted to immediately disallow his citizen’s to use their self-defense tools. Semi-automatic rifles and pistols along with large-capacity magazines were banned within the city limits. He also wanted his automatons to be able to deem people as an “imminent risk” for another reason to breach their peace and to seize their firearms.
A spokesman for Mayor Peduto, Tim McNulty cried in defeat and promised that the city would appeal.
He Exclaimed! “The city and its outside legal counsel have always expected this would be a long legal fight, and will continue to fight for the right to take common sense steps to prevent future gun violence. “We will appeal.” It’s comical watching these folks battle for their “rights” in this Socialist Democracy. At least for now they get a small victory but still remain vulnerable to the next tyrannical spear that will soon head their way.
