The Montana Supreme Court has overridden a ordinance by the City of Missoula that require universal background checks on all gun sales including gun shows and private transfers. The case was brought to the MT Supreme Court by Montana Attorney General Tim Fox who won his case in a ruling of 5-0 in his favor, he argued that the city did not have the authority to infringe on gun rights in the state and U.S. Constitutions. On one hand some claim this takes power away from local governments but local laws can not override the 2nd Amendment.
This brings into question the authority of other cities such as New York that create city level strict gun laws pertaining to how a gun can be carried and how ammo must be stored in a vehicle in a very specific manner. That leads us to ask is it possible to be a responsible gun owner when simply traveling across your state would require you to be a legal expert on every city you cross into. Is it fair to a citizen to be law abiding in one town and become a felon in another within their own state. Which of course is the goal of cities like New York which want to make laws so absurd that even trying to carry a firearm is to difficult to be worth it.
