District Attorney Billy Byrd says Robert Shawn Henson admitted to marrying a woman in Kentucky several years ago, moving to Texas, and remarrying in the state more than a year ago. These State sanctioned transactions went undetected to each other, unlike National databases for other things such as traffic citations, credit, and taxes.
Bigamy is defined by Texas state law as being legally married to two or more people at the same time. The D.A. said that the maximum sentence for bigamy is 10 years, but Henson took a plea deal to receive 8 years. There is no national marriage database to immediately access a person’s marriage background when they apply for a marriage license. Most states excuse a person who reasonably believed that his or her previous marriage had been correctly ended through divorce, death, or annulment. A person can also be excused if he or she had no contact with their spouse for 3-5 years, and for all they knew, they were deceased.

When you marry with a marriage license, you grant the State jurisdiction over your marriage. When you marry with a marriage license, your marriage is a creature of the State. It is a corporation of the State! Therefore, they have jurisdiction over your marriage including the fruit of your marriage. What is the fruit of your marriage? Your children and every piece of property you own. So where is the State’s punishment? The State allowed this to happen so they are the responsible party, throwing a man in a cold cage for 8 long years at the expense of tax payers is absurd. No victim no crime, another government failure in the tracking system known as a Marriage ‘License’.
